Terms and conditions

This is a translation. In case of doubt, the German version applies.

§ 1 Scope and contracting party

These terms and conditions apply to all orders placed through the online shop theturkishmarket.com. Your contracting party is Effinion Technology UG (haftungsbeschränkt), Uferweg 29, 48282 Emsdetten (see legal notice). Deviating terms of the customer do not apply.

§ 2 Conclusion of the contract

The presentation of products in the shop is not a legally binding offer but an invitation to place an order. By clicking the button “Order with obligation to pay” you submit a binding offer to purchase the goods in your cart. Before submitting, you can check and correct your details at any time.

We confirm receipt of your order immediately on the order confirmation page; this confirmation is not yet an acceptance. The contract is concluded when we expressly confirm the order, request payment or dispatch the goods.

§ 3 Contract language and contract text

The contract languages are German and English. We store the contract text. You can view and print your orders with invoices at any time in your customer account. You can retrieve, save and print these terms and conditions on this page.

§ 4 Prices and shipping costs

All prices are final prices in US dollars or euros, according to the currency selected in the shop, and include statutory VAT. For delivery outside the EU the 19% German VAT is deducted at checkout (tax-free export). Shipping costs are added; they are shown in the cart before you place your order and on the Shipping & payment page.

§ 5 Payment

The available payment methods are shown on the Shipping & payment page and during checkout. The purchase price is due when the contract is concluded.

§ 6 Delivery

We deliver to: worldwide (except countries under EU sanctions). The delivery time is 7–14 days after receipt of payment, unless stated otherwise for the product. If a product is unavailable, we will inform you without delay and refund any payments already made.

§ 7 Retention of title

The goods remain our property until paid for in full.

§ 8 Right of withdrawal

Consumers have a statutory right of withdrawal. Details are set out in the withdrawal policy.

§ 9 Warranty

The statutory liability for defects applies. Please report transport damage as soon as possible to backoffice@theturkishmarket.com; this does not affect your statutory rights.

§ 10 Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. For slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract.

§ 11 Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

§ 12 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence.
